TERMS AND CONDITIONS APPLICABLE TO VENUE IN THE VALLEY EVENTS

In this section, words like ‘holder’, ‘bearer’, and ‘purchaser’ will refer to you – the person who will buy the tickets to the Venue in the Valley event. On the other hand, ‘our’, ‘us’, ‘we’, ‘issuer’, ‘provider’, ‘organiser’ and similar terms will indicate the organisers of the Venue in the Valley event – Gulliver’s Valley Limited, company no. 09753831, registered office address – Gulliver’s Kingdom, Temple Walk, Matlock Bath, Derbyshire, DE4 3PG.

The following terms & conditions are applicable to all Venue in the Valley Event tickets purchased directly through the Gulliver’s website, hotline, on Park or through approved third parties. Venue in the Valley Event tickets sold through third parties may have additional terms & conditions imposed by the relevant third party and you should make sure you have read and understood all applicable terms & conditions prior to your booking.

Acceptance of Terms and Conditions

By opting to purchase, allocate or possess tickets to a Venue in the Valley event, you automatically agree to our terms of use. If you have problems with any of the clauses listed below, please do not purchase tickets or try to enter the Venue in the Valley event premises.

Amendments to Terms and Conditions

Please note that Gulliver’s Valley Limited reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions – without any prior notifications to you. Such changes will be duly reflected on the websites of the organiser www.vitv.co.uk and www.gulliversfun.co.uk . These changes will relate back to the date of purchase of the Venue in the Valley event tickets.

Booking and paying for your event ticket(s):

You can book through the websites www.vitv.co.uk or www.gulliversfun.co.uk or by telephoning 01925 444 888 (telephone booking fee applies). Please note that you must be over 18 to make a booking. Full payment is required at the time of making your reservation. Payment may be made online or by telephone.

Payment:

Tickets are offered subject to availability.

The price of one Venue in the Valley event ticket is stated on the websites of the organiser or approved third party seller at the time of purchase. This figure is non-negotiable and all prices displayed are subject to change at any time and without notification.

We accept payment by credit/charge or debit card only. Credit/charge and debit cards will normally be authorised and charged to your account within one working day. We accept MasterCard or Visa. Our current charge for card transactions is 0% however this is subject to change.

Confirmation:

The price for your event ticket(s) and any additional charges, along with details of payments made will be confirmed to you by email within 24 hours of your booking. Please make sure your email address is correct at the time of booking. Please check the details on your confirmation carefully. If any of the details are inaccurate or no longer apply, please inform our reservations team immediately.

Our Contract with You:

When we receive the required payment and you have received a confirmation, a contract is formed. Your receipt of a confirmation will be deemed to have taken place 24 hours after booking if sent electronically and within 10 days if sent by post. If you have not received your confirmation within these timescales please contact us immediately. Please be aware that if a technical error causes the price quoted and paid to be substantially incorrect, we reserve the right to refund the payment and cancel the reservation.

Your principal contract is with Gulliver’s Valley Limited. The contract is made up of the confirmation and these terms (which we sent to you following your telephone reservation or which you accepted online at the time of booking). In respect of Venue in the Valley event bookings, additional terms and conditions relevant to the main Gulliver’s theme parks, and additional Gulliver’s attractions (all available on the website www.gulliversfun.co.uk ) will also form part of the contract if applicable. Our contract with you binds you (the person named on the confirmation), and all members of your party, including children. All members of your party must accept this contract, which remains in effect until the last of your party has left Gulliver’s.

The event service will be deemed to have been delivered in its entirety as soon as the Venue in the Valley event  starts on the specified date. From that point on, no refund requests will be entertained.

Prices:

Prices are subject to change. The most up-to-date prices are on our website and will be quoted when you make a reservation. The quoted price will be inclusive of VAT (at the current rate) and service charges. The agreed price will be on the confirmation.

This price includes:

The cost of your event ticket(s)

Any other amenities or services described as included in the price of your event ticket(s) in the information provided to you.

Your confirmation will specify which event areas may be accessed within the purchase price of your event ticket(s).

The price does not include:

Use of facilities and activities not included within your event ticket(s), for example the main Gulliver’s theme parks, or any additional Gulliver’s attraction entry. Separate charges, agreements and booking arrangements apply for these and other items.

Tickets/admissions:

The ticket you purchase represents a revocable license for you to access Gulliver’s Valley Resort on the date specified, when the Venue in the Valley event is scheduled to be hosted. The licence covers access to the event area only and does not extend to the wider Theme Park or Resort areas unless specified. The license includes the revocable right to attending the Venue in the Valley event. This license can be revoked at any time by the issuer at its sole discretion, without any prior notifications or compensation options. If the license is revoked, you will not be granted entry at the venue. 

All event areas are private property and all persons entering the event area must hold a valid ticket.

All tickets are non-transferable, not for resale and will become automatically void upon any transfer for value.

Tickets purchased are only valid on the date printed on the ticket.

Tickets will only be exchanged or refunded if Gulliver’s, in its absolute discretion, chooses to do so. For the avoidance of any doubt, pre-booked tickets are non-refundable in the event that admission is refused or relinquished upon breach of these terms and conditions.

If tickets are bought on behalf of other guests, the buyer accepts these Terms and conditions on behalf of every guest and shall ensure that these terms and conditions are observed by each person in the group.

If re-entry into the event area is required, an appropriate hand-stamp or ticket must be obtained, before exiting the event area which must be shown at the time of re-entry to regain access.

Tickets must be retained at all times and submitted for inspection if required by Gulliver’s.

No child or children under the age of 16 will be admitted to the event area unless they are accompanied by an adult aged 18 years or over and such child or children whilst on site must remain under the control or supervision of an adult at all times.

Right to refuse entry to or remove from the Attraction:

Gulliver’s, acting reasonably at all times, reserves the right to refuse admission to any persons felt unsuitable for the venue facilities, ban from entry to the venue, or remove from the venue without any right to a refund any person whose presence or behaviour may affect the enjoyment and/or safety of other guests or staff or who: acts in an inappropriate and/or undesirable manner whilst travelling to the venue whether by bus, coach or other means, where such behaviour has been reported to us by a reliable independent source; has been convicted of a criminal offence relating to Gulliver’s, or civil unrest at Gulliver’s property/attractions, which, in our opinion, is likely to affect the safety and/or enjoyment of other guests or staff; uses violent, aggressive, threatening, abusive, discriminatory or insulting words or behaviour or in any way behaves in a manner which may provoke a breach of the peace; climbs or stands upon fences, barriers, walls, safety fences, rock arrangements, ride structures, exhibits or any other buildings at the venue; enters or attempts to enter any part of the venue which is a restricted or prohibited area as determined by Gulliver’s, including ride areas, workshops and changing rooms.

Gulliver’s reserves the right to initiate legal proceedings or prosecute any person who: is found damaging or defacing any part of the grounds, fences, barriers, walls, ride structures, exhibits, fabrics or buildings at the venue or; has displayed any sign or visible representation of any kind which is, or could be reasonably judged to be, threatening, abusive or insulting or; has previously acted in any manner which has caused any person to report that individual to Gulliver’s or; is attempting to regain admission to the venue or has been found inside the venue without a valid ticket or; has purchased or obtained any tickets or discount vouchers from an unauthorised source.

If any guest in breach of any of these terms and conditions is a member of a group, then such group of individuals may also, at Gulliver’s discretion, be denied entry or escorted from the venue without any right to a refund.

Cancellation:

Gulliver’s Valley reserves the right to cancel a Venue in the Valley Event for any reason. In the event that cancellation is necessary we will notify guests using the email used to book the tickets and post a notification on our websites.

If the Venue in the Valley Event is cancelled in its entirety, Gulliver’s Valley Limited has the sole and absolute right to:

i) reschedule the event, or

ii) issue a full refund

Gulliver’s Valley will not be held liable for any incidental costs that occur as a result of cancellation including but not exhaustive to costs relating to: travel, hotel, restaurants, or food and drink purchases.

Please note that the decision of the issuer in such cases will be deemed final and binding.

If the Venue in the Valley event is cancelled or rescheduled due to any factors or causes not in the control of the issuer, the latter will offer a full refund, or postpone the event, or provide a comparable ‘make good’ option. These factors will be inclusive of, but not limited to, natural disasters, strikes, delays in production, and the like. Once again, the decision of Gulliver’s Valley Limited will be considered final.

Any refund, if issued, will include ONLY the face value/printed value of the ticket(s). The bearer cannot, under any circumstances, claim refunds on shipping fees, processing fees, handling fees, and such other charges.

Losses, if any, occurring due to foreign exchange fluctuations at the time of refunds, have to be borne by the purchaser. 

All ticket sales are deemed as FINAL TRANSACTIONS. There will be no ticket returns/exchanges/cancellations.

Alcohol and drugs

No alcohol is allowed to be brought onto the site at Gulliver’s Valley. Gulliver’s reserves the right to request a search of customers bags and prevent the admission of guests carrying alcohol or suspected of carrying alcohol. Guests that become inebriated may be asked to leave the event and premises.

Anyone suspected of taking or under the influence of illegal drugs or legal highs will not be admitted and/or will be removed from the venue.

Prohibited items

The use of your own music system or recording device including mobile phones, laptops and tablets is not allowed within the designated event area during the event period. No fires or barbecues are permitted on the event site.

Guests’ property

Vehicles and guests’ property are brought on to the event site at your own risk. Gulliver’s Valley Limited does not accept responsibility for any loss, damage or theft of any item. Gulliver’s Valley Limited will not be held responsible for any damage or loss of guests’ property howsoever caused.

Data Protection

The use of personal information supplied to us is governed by Gulliver’s “Privacy Policy”. We keep all data in our secured systems and will act to keep it secure in accordance with the Data Protection Act 1998. Your personal information is not given to any third party. Any client testimonials or quotes will only be used on the website or other marketing material with the express permission of the individual. Under Data Protection legislation all individuals have the right to access their personal data and when processing data on your behalf we will comply with the provisions of the Data Protection Act 1998 and subsequent legislation as enacted.

Legal Liability

Gulliver’s takes every effort to ensure that information contained on our website is accurate. However, no liability is accepted arising from reliance upon information contained on these pages or any other information accessed via this website. We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. As required by law, our liability is not limited in the event of death or personal injury caused by our negligence or in relation to fraud or fraudulent misrepresentation.

Force Majeure

While every effort will be made by the Company to fulfil your order, where accepted, the full performance of this contract is subject to variation or cancellation by the Company consequent upon an act of God, war, strikes, riots, lock-outs or other labour disturbances, fire, flood, restrictions of the use of transport, fuel or power, requisitioning, shortage of material or transport or labour or any other cause beyond the control of the Company. In the case of extreme bad weather conditions, the company reserves the right to cancel the event and offer an alternative date.

No Waiver

No failure or delay by Gulliver’s in exercising any of its rights under the Agreement shall be deemed to be a waiver of that right, and no waiver of a breach of any provision of the terms and conditions shall be deemed to be a waiver of any subsequent breach of the same or any other provision.

Severance

If one or more of the provisions of these terms and conditions is found to be unlawful, invalid or otherwise unenforceable, those provision(s) shall be deemed severed from the remainder of these terms and conditions and shall remain enforceable.

No Partnership

Nothing in these terms and conditions shall constitute or be deemed to constitute a partnership, joint venture, agency or other fiduciary relationship other than the contractual relationship expressly provided for in these terms and conditions.

Third Parties

No part of these terms and conditions shall confer rights on any third parties and accordingly the Contracts (Rights of Third Parties) Act 1999 shall not apply.

Jurisdiction and Governing Law

These terms & conditions and all disputes, whether contractual or otherwise, arising out of or in connection with them are governed by and shall be construed in accordance with the laws of England and Wales and each party submits to the exclusive jurisdiction of the English courts.
